Gary M. Tocci
Gary M. Tocci is a principal in the Philadelphia, Pennsylvania, office of Jackson Lewis P.C. His practice focuses on representing employers in workplace law matters, including preventive advice and counseling. He has more than 25 years of experience in litigating both employment law and traditional labor law matters.
Gary’s experience includes handling NLRB unfair labor practice charges and trials, labor arbitrations and other labor proceedings in federal and state courts. He also represents employers before state and federal agencies and courts. Gary has extensive experience defending employers in all types of employment litigation matters, including claims under Title VII, ADA, ADEA, and FMLA.
Prior to joining Jackson Lewis, Gary was a partner for 15 years in a labor and employment practice at a global law firm.
During law school, Gary served as editor-in-chief of the Temple Law Review. Directly after law school, he served a clerkship in the United States District Court for the District of Delaware.
Recent Litigation Experience
- Argued in open court and secured dismissal of federal court Section 301 action for employer and obtained more than $13,000 in attorneys’ fees for vexatious litigation under 28 U.S.C. section 1927.
- Successful in having federal court labor law action against employer dismissed under Rule 37 FRCP for plaintiff’s failure to cooperate in discovery.
- Prevailed in labor arbitration having national implications on job accrual issue.
