David A. Kelly
David A. Kelly is of counsel in the Washington, DC Region office of Jackson Lewis P.C. His practice focuses on representing employers in workplace law matters, including preventive advice and counseling.
David works closely with employers to navigate issues arising under the National Labor Relations Act (the Act) and related matters. He handles unfair labor practice (ULP) and representation petition proceedings at every stage before the National Labor Relations Board (NLRB), including ULP investigations and trials, Section 10(j) injunction proceedings, subpoena enforcement proceedings, pre- and post-election representation case matters, and representation elections. For unionized employers, David assists with collective-bargaining, contract administration advice, grievance and arbitration proceedings, training, and long-term strategy. For non-unionized employers, he helps train managers and supervisors to avoid the pitfalls that may lead to union organizing and consults on policies and procedures to comply with the Act and other federal and state laws.
Before joining Jackson Lewis, David worked for the NLRB for 24 years. From 2000 to 2011, he served as a field attorney, supervisory attorney, deputy regional attorney in Region 28 (Phoenix), where he litigated and oversaw the litigation of many high-profile cases. From 2011 to 2024, David served as a deputy assistant general counsel in the Division of Operations Management (Washington, D.C.) where he assisted the General Counsel in managing regional offices and providing programmatic support for the national enforcement and administration of the Act and was extensively involved with the Agency’s labor relations, outreach activities, and training programs.
