Jackson Lewis Shareholder Testifies Before House Subcommittee on Workforce Protections

WASHINGTON, D.C. (February 11, 2014) – On Tuesday, February 4, Jackson Lewis P.C. Shareholder Bradford T. Hammock testified before the U.S. House of Representatives Education and the Workforce Committee, Subcommittee on Workforce Protections, on behalf of the U.S. Chamber of Commerce.  The hearing, “OSHA’s Regulatory Agenda: Changing Long-Standing Policies Outside the Public Rulemaking Process” featured testimony regarding instances in which witnesses said the Occupational Safety and Health Administration (OSHA) altered standards outside the formal regulatory process.

Mr. Hammock, Leader of Jackson Lewis’ Workplace Safety and Health practice group and a former regulatory attorney for OSHA, testified that “OSHA has decided to push out new policies and in some cases new requirements without bothering to follow the requirements of rulemaking or involving those who would be affected by these changes.”  Many of OSHA's actions amount to substantive changes without the impact analyses, public comment or clearance from other administration agencies that ordinarily serve as a check on regulatory action, Mr. Hammock said.

The National Association of Manufacturers and the Associated Builders and Contractors, as well as other witnesses, also presented testimony at the February 4th  hearing.
