Over a year into the Biden administration, the Office of Federal Contract Compliance Programs (OFCCP) is signaling an even more aggressive approach to enforcement. The Agency’s recent actions suggest they will increase investigations into compensation practices, create less certainty in compliance reviews and seek to invade the attorney-client privilege. These actions will lead to burdensome and intrusive compliance reviews but they also suggest certain compliance program enhancements that can make the audit process easier.
