The number of federal legislative options continue to grow and more states are passing legislation protecting the rights of student-athletes to commercialize the use of their name, image and likeness (NIL). The NCAA has yet to act and is awaiting the onslaught of state laws taking effect on July 1, as well as the Supreme Court’s upcoming decision in the Alston case. The resulting impact of the state NIL laws, potential federal legislation and the Supreme Court’s upcoming ruling has created many potential compliance issues and concerns for college and university officials, including athletic directors, coaches, compliance staffs and their student-athletes.
