April L. Upchurch is an Associate in the Portland, Oregon office of Jackson Lewis P.C.
Ms. Upchurch advises employers on a variety of issues including employee discipline and termination, employment discrimination, state and federal leave laws, disability accommodation, wage and hour compliance, employment policies and practices, and non-compete agreements. In dealing with her clients, Ms. Upchurch emphasizes the importance of preventive counseling to minimize the risk of costly litigation. In addition to counseling clients, Ms. Olsen litigates single plaintiff and class action cases in state and federal court, and appears before administrative agencies such as the Equal Employment Opportunity Commission, the National Labor Relations Board, and the Department of Labor and Industries.
She spent the first several years of her career representing labor unions. As a result, Ms. Upchurch has significant experience with organizing campaigns, elections, unfair labor practices, arbitration, and collective bargaining. Ms. Upchurch has also trained managers and union officials on the principles of just cause discipline, Weingarten rights, protected activity, and lawful election campaigning. She has represented management exclusively since 2004.
While in law school, Ms. Upchurch served as a legal extern for the Honorable Claudia Wilken, U.S. District Court, Northern District of California. She also served as a law clerk for the Public Interest Law Firm, the City of Berkley, and for a labor law firm. During these clerkships, Ms. Upchurch worked on a variety of Constitutional and employment and labor law matters.
She is admitted to practice law in Oregon and Washington.
Ms. Upchurch received her J.D. from Northeastern University School of Law in 2001. She received her B.A. in Political Science and History from the University of Oregon in 1996.
