Biography
Michael J. Lotito is a Member of Jackson Lewis’ Management Committee and a Partner who travels nationwide for Jackson Lewis LLP. Mr. Lotito practices all aspects of traditional labor relations, including matters arising under the National Labor Relations Act. As labor unions have turned to corporate campaigns to increase their membership, Mr. Lotito has advised clients regarding how to combat this new technique. The number of corporate campaigns he has advised clients on is extensive. In this regard, he regularly assists clients in conducting internal and external vulnerability assessments to create stronger organizations which, as a by-product, help pre-empt union organizing. Mr. Lotito is also one of the nation’s leading authorities on preventive strategies in the workplace. He serves as lead counsel for some of the country’s largest corporations, helping them develop strategic solutions to labor and employment issues and implement business, legal, and preventive strategies effectively. In addition, Mr. Lotito advises organizations on all matters affecting the employer-employee relationship such as conflict resolution, alternate dispute resolutions, and equal employment opportunity concerns. He has testified before the U.S. Senate and House of Representatives, as well as the Equal Employment Opportunity Commission. Mr. Lotito is well known for his engaging and passionate presentation style. A noted speaker and presenter, Mr. Lotito addresses an extensive variety of management groups including Boards of Directors, company executives, managers and supervisors, and trade association representatives. He has trained literally thousands of managers and supervisors over the course of his career. He is one of the firm’s key faculty for its nationally recognized How To Stay Union Free program, which is offered eight times a year in major cities throughout the country. Mr. Lotito is a frequent commentator in the national news media regarding workplace and labor law issues and events. He has appeared on PBS’s “NewsHour with Jim Lehrer,” FOX News and on National Public Radio. Mr. Lotito, as an adamant opponent of the Employee Free Choice Act (“EFCA”), has spoken out against the bill’s potential harm to both employees and employers, most recently on FOX Business News. Mr. Lotito has been featured as a special guest, along with George McGovern, on a CBS radio program on the topic of EFCA. Because of his expertise and reputation as an expert on EFCA legislation, Mr. Lotito has become a resource on the subject and been quoted in EFCA articles in the New York Times and HR Executive Magazine. The Wall Street Journal published his Letter to the Editor about EFCA’s binding arbitration provision. Additionally, Mr. Lotito has spoken about workplace issues throughout the world, including locations such as Germany, Taiwan, South Africa, and virtually every state in the United States before a wide variety of audiences. Mr. Lotito has been more generally quoted in The New York Times, Wall Street Journal, Forbes, BusinessWeek, Washington Post, Boston Globe, USA Today, Los Angeles Times, San Francisco Chronicle, Sacramento Bee, Houston Chronicle, National Law Journal, Nation’s Business, Harvard Business Review, and other major publications. Mr. Lotito has been recognized with a lifetime Senior Professional in Human Resources (SPHR) certification. He chaired the 260,000-member Society of Human Resource Management (SHRM), served as chairman of SHRM’s National Legislative Affairs Committee, and was a member of its Employee and Labor Relations Committee. He is a member of Vistage 200, an honor and designation that places him among the top one percent of all Vistage presenters in the world. (Vistage is the world’s largest CEO member organization.) He is a member of the Labor and Employment Case Selection Committee of the National Chamber Litigation Center. Mr. Lotito is also a member of the 2009 Employment Law 360 editorial advisory board. Mr. Lotito co-authored four books on the ADA: The Job Placement-ADA Connection, Americans with Disabilities Act: Are You Prepared?; The Americans With Disabilities Act: A Comprehensive Guide to Title I; Americans With Disabilities Act: Making the ADA Work for You; and What Managers and Supervisors Need to Know About the ADA. He has written three articles on the ADA: “Staying creative, working at preventive strategies key to ADA compliance” for the Disability Compliance Bulletin in 2005; “Integrate Claims Management with ADA Compliance” for HR Magazine in 1993; and “Shining Light on ADA” for HR Magazine in 1992. Mr. Lotito was a co-author with other Jackson Lewis partners for the U.S. Chamber of Commerce publication, The Employee Free Choice Act: Piercing the Rhetoric, a definitive explanation of EFCA. He also co-authored EFCA-related articles and opinion pieces published in Employment Law 360, Chain Store Age, and Directorship Magazine. Some of Mr. Lotito’s other published articles include “AIDS in the Workplace: A Practical Guide for Employers” for The Practical Lawyer; “Life After Foley: What Will It Be?” for Personnel; and “Labor Relations Considerations for the New High-Technology Company” for the Santa Clara Computer and High Tech Law Journal. He also has authored articles for other respected publications, including HR Magazine, Human Resources Executive, and The Journal of the Association of Corporate Counsel ACC Docket. He is a co-author of the book, Minding Your Business: Legal Issues and Practical Answers for Managing Workplace Privacy. Finally, he writes a monthly column entitled “The Employment Law Revolution” for Entrepreneur.com addressing employment law concerns. Mr. Lotito, AV-rated by Martindale-Hubbell, is admitted to practice in California and is a member of the California Bar Association. He is an American Bar Foundation Fellow, an honor extended to a small number of ABA members. He has been recognized as one of the Northern California Super Lawyers for 2010. Mr. Lotito received both his B.S. in Political Science and his J.D. from Villanova University in 1970 and 1974 respectively. Villanova University’s Graduate Program in Human Resources named him the Top Human Resources Alumnus of the 20th Century.
